Disclaimer
Dead Seas is an independent game made by Doscore Games and Binary HQ ("we", "us"). It is not made, licensed, endorsed or sponsored by any of the companies named below.
Sony and the PlayStation 2
"PlayStation", "PS2" and the PlayStation logos are trademarks or registered trademarks of Sony Interactive Entertainment Inc. Dead Seas is not affiliated with, endorsed by, sponsored by or licensed by Sony Interactive Entertainment. The PlayStation 2 version is unofficial homebrew software.
Running homebrew software needs a console set up to run it. We do not supply, sell or support console modification tools, BIOS files, firmware or any Sony software, and nothing we distribute contains them. Modifying a console may void its warranty and may be restricted where you live; doing so is your choice and at your own risk. Only use software and hardware you are entitled to use.
Other names
Windows and MS-DOS are trademarks of Microsoft Corporation. Apple, Mac, Mac OS and macOS are trademarks of Apple Inc. FreeDOS is a trademark of Jim Hall. Linux is a trademark of Linus Torvalds. All other names belong to their owners and are used only to say which systems the game runs on. None of these companies or projects is connected with Dead Seas.
Third-party software
The game CD carries FreeDOS and other free software, each under its own licence. The licences, and where to get the source code, are on the disc and listed with each download.
Fiction
Dead Seas is a work of fiction. Historical figures, ships and navies that appear in it are portrayed fictionally, and their appearance is not an endorsement of anything they did or believed.
Terms of use
These terms are between you and us, and apply when you play Dead Seas, use the official server or use this website.
1. Your licence
We give you a personal, non-transferable licence to install and play Dead Seas. A registration serial is for one person and covers every version of the game on the machines you own. Please do not sell, share or publish your serial or a registered copy, or remove the notices in the game. Testers' copies are also covered by the tester agreement they signed.
2. Playing online
- You must be 13 or older to play online.
- Be decent in chat and in names: no abuse, harassment, threats, hate, sexual content, spam, or pretending to be someone else, including us.
- No cheating, exploiting bugs on purpose, attacking the server, or using someone else's serial.
- We may mute, remove or suspend a player or a serial that breaks these rules, and act on notices from Australia's eSafety Commissioner. To report someone, write to support@deadseas.net.
- Unregistered copies play online as pirates. On the official online server, one serial may have one captain at sea at a time. Play on your own local network (LAN) is not limited: one serial covers every machine on it.
3. The online service
We run the official server and will keep improving it, which means it may change or be down for maintenance. If we ever stop running it, we will give reasonable notice first. The game can also be played on servers run by players themselves.
4. Your rights under Australian law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms takes away those rights or any similar rights you have where you live. Apart from those rights, the game and the website are provided as they are, and to the extent the law allows we are not liable for indirect or consequential loss.
5. Changes and the law
We may update these terms; the date at the top says when. These terms are governed by the law of Queensland, Australia.
Terms of sale and pre-orders
- Registering interest is not a purchase. Nothing is charged and nothing is owed. When pre-orders open we email you once with the link; ask us any time to take you off the list.
- Prices are in Australian dollars. The registered download is AUD $15. The boxed edition's price will be published before it is offered.
- The download is delivered as a serial by email, usually straight away.
- The boxed edition is a limited pressing posted from Australia. Postage is extra and is shown before you pay; delivery times are estimates.
- Payments will be taken by a payment provider. We never see or store your card details.
- Refunds and problems: if the game does not work as described, or the box arrives damaged or not at all, write to support@deadseas.net. You have the remedies the Australian Consumer Law gives you, including a refund or replacement for a major failure.
Privacy notice
We follow the Australian Privacy Principles, and the GDPR and UK GDPR for players in Europe and the UK. We collect as little as we can.
What we collect, and why
- Your email address: to send your serial, answer you, and (only if you asked) tell you when pre-orders open.
- Your name and postal address: only for the boxed edition, to post it.
- Your serial and online name: to let you log in and to stop misuse of serials.
- When you play online: your IP address, when you logged in, the games you joined and the chat you sent. These are kept in the server's logs for up to 30 days, to run the service, keep it safe and deal with reports.
- If you apply to test the game: your name, email, country and the machine details you send on the application form, and the IP address it came from (to stop spam). If you join, also the signed tester agreement.
- Crash logs: only the ones you choose to send.
- This website sets no cookies and uses no trackers or analytics. Like any web server, ours records the IP address of each request for security, kept briefly.
Where it is kept, and who sees it
The game server and website run on a server in Australia. Email is handled by our email providers, including Google, which may store it outside Australia. A payment provider will process payments when they open. Postage details go to the postal service that carries your box. We do not sell or rent your information, and we only share it with these providers, or where the law requires.
The legal basis (Europe and the UK)
We use your details to carry out our agreement with you (registration, delivery, online play), for our legitimate interest in keeping the service safe, and with your consent for any news we send.
Your choices
You can ask to see, correct or delete what we hold about you, or to stop any email, by writing to support@deadseas.net. Every email we send that is not a receipt has an unsubscribe link. We do not knowingly collect information from children under 13.
If something goes wrong
If we ever have a data breach that could harm you, we will tell you and, where the law requires, the regulator. If you are unhappy with how we handled your information, contact us first; you can also complain to the Office of the Australian Information Commissioner (oaic.gov.au), or in Europe or the UK to your data protection authority.
